Legal Objections to Hannibal Gaddafi’s Release in the Case of Imam Sadr’s Disappearance
Following the decision of the investigative judge in the case of the disappearance of Imam Musa al-Sadr and his companions, Judge Zaher Hamada, to release the detainee Hannibal Gaddafi in exchange for a large financial bail, the case has returned to the forefront amid legal objection.
Informed sources confirmed that the family of Sheikh Mohammed Yaqoub, who was kidnapped with Imam Sadr, submitted two objection requests through their legal representative, lawyer Naji Ayoub, to the competent judicial authority. The first request objects to the release decision itself, attaching the reasons for its rejection. The second request objects to the value of the bail in terms of guaranteeing attendance and follow-up, given the size and seriousness of the case.
The family of Sheikh Mohammed Yaqoub had issued a strongly worded statement, considering that the decision to release Hannibal Gaddafi clearly reflects the extent of political interference in the work of the Lebanese judiciary. The statement pointed out that the media campaign and political pressure that preceded the decision, in addition to the performance of the Minister of Justice in the past period, confirm this interference.
The family believes that the decision contains a clear contradiction, as the circumstances of Gaddafi’s arrest and the charges against him have not changed. At the same time, the recent interrogation did not address the core of the case, but was limited to marginal points, in disregard of the family’s repeated demands for a serious and effective investigation.
The statement added that what was rumored about the deterioration of Gaddafi’s health and “arbitrary detention” was part of a deliberate campaign to mislead public opinion. It confirmed that his public appearance upon the issuance of the release decision revealed his good health and refuted those allegations.
