The Austrian Data Protection Authority has convicted Microsoft for violating privacy rules. The Microsoft 365 education platform was found to be illegally tracking students and schools and using their data for company purposes.

The data protection organization “noyb” confirmed that the platform used tracking cookies without user consent, in violation of European privacy protection laws.

A noyb data protection lawyer pointed out that Microsoft usually claims to be committed to protecting privacy, but the investigation showed otherwise, as the company tried to shift data protection responsibilities to schools and national institutions. The ruling means that Microsoft must clarify whether it has shared student data with its other platforms such as LinkedIn, otherwise the use of the platform will remain incompatible with EU law.
